Calling a man bald can now be classified as a form of sexual harassment. This according to a ruling in the UK after an employment tribunal judge agreed the notion can be an unsolicited sexual innuendo.
The three-member tribunal, who also cited their experience with hair loss said that; baldness was more prevalent in men than women, therefore, they argued that the use of the word “bald” would be an insult related to a “protected characteristic of sex.”
The tribunal expressed that calling a man bald is tantamount to commenting on the size of woman’s breasts, based on a 1995 case.
The ruling which was on published Wednesday, was based on a case where the insult was alleged to have been used against Tony Finn, during his time working as an electrician for the British Bung Manufacturing Company.
Finn had who was employed at the company for 24-years, was fired last year and the circumstances around his dismissal were also said to be used as reference points of the case.
The Electrician claimed that he was called a “bald c—” and subjected to threats by his shift supervisor, Jamie King, during a dispute in July 2019.
The tribunal determined that it’s use an insult was a “violation against the claimant’s [Finn] dignity, it created an intimidating … environment for him, it was done for that purpose, and it related to the claimant’s sex” as per sky news.
They also shared that issue was not the use of profanity, but that intentions with the use of the term, with Finn. “Although, as we find, industrial language was commonplace on this West Yorkshire factory floor, in our judgment Mr King crossed the line by making remarks personal to the claimant about his appearance.”
As per the judgment, Finn is now set to receive compensation based on the tribunal’s ruling, though the amount had not yet been determined.
