Electronic manufacturing giant Apple is reportedly being sued by the family of a 12-year-old boy, who is said to have suffered hearing impairment after loud alert went off in his ear pods.
According to reports the family filed the suit on Monday, and claims that the child has suffered permanent auditory loss after an Amber Alert went off while he was watching a Netflix on his phone.
The report claims that the volume of the Amber alert was at a dangerous level which caused a Rupture of his eardrum.
It further added the family’s claims of the product being defective, due to decibel levels of the device used by the minor remaining at a very high level irrespective of how low the volume was.
According to legal documents as per TMZ they are accusing the company of negligence and fraud asserting that his life was “severely affected altered” as a result.
Adding that he now suffers from dizziness and is forced to wear a hearing aid, after initially having tinnitus from the jolt the loud alert.
The father of the child Carlos Gardoa says that Apple was aware of the extremely loud levels of Alerts on their devices also that it did adjust to the selected levels of volume.
A response has yet to be released by the company on the matter
