Geico ordered to pay woman $5.2 million after she contracts STD from car sex

Well-known American auto insurance company, Geico is facing a possible payout of $5.2 million to a Missouri woman known only as M.O., who claims she contracted a sexually transmitted disease (STD) during a sexual encounter in the car of a man insured by the company.

The Missouri Court of Appeals Western District on Tuesday upheld the decision of a Jackson County Court to reward the woman for damages caused by the 2017 incident with her then-boyfriend. M.O stated she unknowingly contracted HPV, human papillomavirus after he failed to disclose his condition to her and argued that his insurance covers such instances.

On February 25, 2021, she notified Geico that she would be seeking a $1 million insurance settlement. The insurance company denied this claim stating it didn’t arise from normal vehicular use and M.O. took the case to an arbitrator.

According to court documents, the insured “negligently infected M.O. with HPV and awarded her $5.2 million in damages for past and future medical expenses. As well as past and future mental and physical pain and suffering”

Geico sought to intervene in the court case sighting that they were unaware the couple had entered arbitration and that this arbitration award was reached through collusion and fraud, which violated their rights to due process and was unenforceable.

This request was rejected and the reward upheld. According to court documents this prompted Geico to again intervene stating that they didn’t have a “meaningful opportunity” to defend their interests.

Geico has filed a separate lawsuit stating the insured’s policy doesn’t cover the claim.
