No prison time for ex-cop who shot 13-year-old student

Former Police Corporal Kirk Haye, who was on Thursday, sentenced to 2 years imprisonment for unlawful wounding in the shooting incident 13-year-old school girl from the Convent of Mercy Academy in Kingston five years ago will receive no prison time.

This comes after his Attorney Peter Champagnie QC had asked the judge to consider a number of factors including his client’s 18-year contribution to the Jamaica Constabulary Force.

Mr. Champagnie also alluded that the policeman had helped to recover a number of illegal firearms and received 10 commendations.

As such, Haye’s sentence was suspended for two years pending good behavior for the period.

The suspended sentence also means that if he is not convicted of any offence within the next two years, then he will not have to serve the two years’ imprisonment.

Reports indicate that on the day in question, the driver of a taxi which was transporting Convent of Mercy Academy (Alpha) and St George’s College students was stopped by the police but drove away after briefly complying.

The police then fired at the vehicle and one of the bullets hit the female student in the head.

Haye, who at the time was assigned to the Mobile Reserve Unit was subsequently charged with unlawful wounding while four of his colleagues were charged with misconduct in a public office and attempting to pervert the course of justice.

However, the four were acquitted of the charges.

In addition, Haye also stood resolute during the trial that he was not involved in the incident, however ballistic evidence presented by INDECOM Prosecutors revealed that the weapon used in the shooting belonged to Haye.
